Terms & Conditions
 

The following terms and conditions apply to the legal services provided by Law By Montoya. Please read them carefully before requesting our services.

 

Services:
We provide legal advice and representation in areas such as business law, real estate law, estate planning, estate probate, agriculture law, and general legal advice. The scope and costs of each engagement will be outlined in a separate written agreement detailing the issues to be addressed and fees to be charged.
 

 

Fees:
Our fees are based on flat fee rates or  hourly rates that vary depending on the complexity of the matter and seniority level of the attorney(s) working on your case. We may request an upfront retainer before beginning work on your matter. We will provide regular invoices and expect timely payment within 30 days. Outstanding balances past due over 60 days may accrue interest charges of the legal limit of the state where client is domicile and services were rendered. 
 

 

Confidentiality:
After retaining (signing an engagement letter and paying the flat fee or retainer amount) to Law By Montoya, information you provide us is protected by attorney-client privilege and will be treated as strictly confidential unless you provide express permission to disclose particular details or we are otherwise legally required to reveal information. Communication:
We will keep you reasonably informed concerning the status of your matter. Please promptly inform us of any changes to contact details. We may record phone calls to ensure accuracy. Urgent issues should be flagged as such for priority handling.
 

 

Termination:
You may terminate our representation at any time in writing. We may terminate representation if you fail to honor the terms of our agreement or for other just cause. In either case, you will remain responsible for paying for all legal services provided and costs incurred prior to termination.

Disputes:
We will strive to resolve any concerns you have about services through direct communication. If we cannot arrive at a mutual resolution, you would have the option to pursue mediation or binding arbitration [or other standard recourse options].
 

 

Changes:
We reserve the right to periodically update these terms and conditions and will provide notice of material changes. The latest version will always be available on our website at Terms & Conditions. The version in place when you sign a services agreement is controlling.
